Notification No. 124

Amendment of the Income-tax Rules under section 194K of the Income-tax Act, 1961

What this is

Notification No. 124 was published on 30 March 2005. Its subject is Amendment of the Income-tax Rules under section 194K of the Income-tax Act, 1961.

This amends the Income-tax Rules. What it changes is the Rules, not the Act — and a rule can never take away what the section gives.

What it does

By the Income-tax (Eleventh Amendment) Rules, 2005, made under section 295 of the Income-tax Act, 1961, the Central Board of Direct Taxes amends rule 37 of the Income-tax Rules, 1962 in Part VI, substitutes rule 37E in Part VI-A, and substitutes Form Nos. 24, 26, 27 and 27E in Appendix II. In the Table to rule 37, against serial number 2, in column (1), the words 'and under section 194K from "Income in respect of units"' are substituted by 'under section 194K from "Income in respect of units" and under section 194LA from "Payment of compensation on acquisition of certain immovable property"', so that the entry now takes in deductions under section 194LA as well. The substituted rule 37E requires every person collecting tax in accordance with section 206C to deliver, in respect of a financial year, the return for collection of tax in Form No. 27E to the income-tax authority referred to in rule 37F by the end of June following the financial year.

Who it reaches

The provisions it speaks to

Left, the provision of the Income-tax Act, 1961 as the instrument itself names it. Right, the section of the Income-tax Act, 2025 that the department’s own concordance maps it to — which is where the same ground is now covered.

What it changes

The rule numbers are the 1962 Rules’ own, as the notification names them. The right-hand column is the department’s own mapping into the Income-tax Rules, 2026, which renumbered nearly everything.

Forms it touches. Form No. 24, Form No. 26, Form No. 27, Form No. 27E

From when

the date of publication in the Official Gazette.

What to watch

Where you meet it

In the annual returns of tax deducted or collected at source, and in the deduction of tax on compensation paid on compulsory acquisition of immovable property.

What it names

Forms it names. Form No. 24, Form No. 26, Form No. 27, Form No. 27E

Rules it names. Rule 37, 37E, 37F of the Income-tax Rules, 1962. The 1962 Rules were replaced by the Income-tax Rules, 2026, which renumbered nearly everything: a rule number quoted here almost never means the same rule today.

On the same provision

Other instruments in this library that name the same provision of the 1961 Act. They are not necessarily still operative, and a later one may have replaced an earlier one without saying so.

What a notification is. A notification is made under a power the Act itself gives, and within that power it is law — unlike a circular, which only binds the department. Its reach is the reach of the enabling provision and no wider, and the date it carries decides from when it works.
