Notification No. 292

Amendment of the Income-tax Rules under section 23 of the Income-tax Act, 1961

What this is

Notification No. 292 was published on 13 November 2003. Its subject is Amendment of the Income-tax Rules under section 23 of the Income-tax Act, 1961.

This amends the Income-tax Rules. What it changes is the Rules, not the Act — and a rule can never take away what the section gives.

What it does

The Central Board of Direct Taxes, in exercise of the powers conferred by section 295 read with section 80LA of the Income-tax Act, 1961, makes the Income-tax (26th Amendment) Rules, 2003, inserting rule 19AE in the Income-tax Rules, 1962 after rule 19AD and inserting Form No. 10CCF in Appendix II after Form No. 10CCE. Rule 19AE provides that the report of the accountant required to be furnished by the assessee under sub-section (3) of section 80LA shall be in Form No. 10CCF. In that Form the accountant certifies that he has examined the accounts and records relating to the business of the Offshore Banking Unit or Units owned by the assessee and situated in a named Special Economic Zone, and states the deduction claimable under sub-section (1) of section 80LA for the assessment year, determined on the basis of the income received in convertible foreign exchange and worked out in Annexure A. Annexure A calls for the name, assessment year and permanent account number of the assessee, the name and address of the Offshore Banking Units with a copy of the permission obtained under clause (a) of sub-section (1) of section 23 of the Banking Regulation Act, 1949, the gross income of the Unit from eligible banking operations referred to in sub-section (2) of section 80LA, less the gross income not received in convertible foreign exchange, giving gross eligible income, less the expenses attributable to it, giving the income eligible for deduction.

Who it reaches

The provisions it speaks to

Left, the provision of the Income-tax Act, 1961 as the instrument itself names it. Right, the section of the Income-tax Act, 2025 that the department’s own concordance maps it to — which is where the same ground is now covered.

What it changes

The rule numbers are the 1962 Rules’ own, as the notification names them. The right-hand column is the department’s own mapping into the Income-tax Rules, 2026, which renumbered nearly everything.
Rule of the 1962 RulesNow, in the 2026 Rules
Rule 19AErule 69
Rule 19ADrule 71

Forms it touches. Form No. 10CCF, Form No. 10CCE

From when

13 November 2003, the date of issue of the notification.

What to watch

Where you meet it

In the accountant's report filed with the return of a bank claiming deduction under section 80LA for an Offshore Banking Unit, and in the assessment of that claim.

What it names

Forms it names. Form No. 10, Form No. 10CCE

Rules it names. Rule 19AE of the Income-tax Rules, 1962. The 1962 Rules were replaced by the Income-tax Rules, 2026, which renumbered nearly everything: a rule number quoted here almost never means the same rule today.

On the same provision

Other instruments in this library that name the same provision of the 1961 Act. They are not necessarily still operative, and a later one may have replaced an earlier one without saying so.

What a notification is. A notification is made under a power the Act itself gives, and within that power it is law — unlike a circular, which only binds the department. Its reach is the reach of the enabling provision and no wider, and the date it carries decides from when it works.
