Notification No. 99/2026 [F.No.300196/16/2024-ITA-I] / SO 4121(E) : Notification under section 536 (1) of the Income Tax Act 2025 (30 of 2025) in the case of Chhattisgarh Real Estate Regulatory Authority was published on 27 July 2026. Its subject is [भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3.
This grants an exemption or a relief under a provision that allows one. Read the conditions attached: an exemption notification is construed strictly, and a condition missed is the exemption lost.
The Central Government notifies the Chhattisgarh Real Estate Regulatory Authority (PAN AAAJC1049H), an authority constituted by the State Government of Chhattisgarh, for the purposes of clause (46) of section 10 of the Income-tax Act, 1961. The specified income exempted is grant-in-aid or loan or advance received from Government, fees and penalties received from builders, developers, agents or other stakeholders under the Real Estate (Regulation and Development) Act, 2016, and interest earned on those receipts. Although the 1961 Act stands repealed by section 536(1) of the Income-tax Act, 2025, the notification is issued in pursuance of section 536(2)(a) to (c) and (e) of the 2025 Act, which save the operation of the repealed Act for earlier tax years and pending proceedings.
Section 536(2) of the Income-tax Act, 2025 keeps the repealed 1961 Act in operation for tax years beginning before 1 April 2026 and for pending proceedings, so an exemption for those years must still be notified under the old law.
