Notification No. 11/2021 [F. No. 370142/52/2020-TPL] / GSR 155(E) was published on 5 March 2021. Its subject is Ministry of Finance.
This amends the Income-tax Rules. What it changes is the Rules, not the Act — and a rule can never take away what the section gives.
The Income-tax (1st Amendment) Rules, 2021 insert a new rule 3B into the Income-tax Rules, 1962, after rule 3A. Rule 3B prescribes how to compute the annual accretion — by way of interest, dividend or any other amount of a similar nature — to the balance to the credit of a fund or scheme referred to in sub-clause (vii) of clause (2) of section 17, which is taxable as a perquisite under sub-clause (viia) of that clause. The taxable perquisite is computed by the formula TP = (PC/2)*R + (PC1 + TP1)*R, where PC is the employer's principal contribution in excess of Rs. 7.5 lakh made during the current previous year, PC1 and TP1 are the corresponding aggregates for previous years commencing on or after 1 April 2020 other than the current previous year, R is I divided by Favg, I is the income accrued during the current previous year in the specified fund or scheme account, and Favg is the average of the opening and closing balances of that fund or scheme for the current previous year.

| Rule 3B | rule 17 |
1 April 2021.
In the perquisite value shown in the salary computation and in tax deducted at source under section 192, and in the salary head of the employee's return of income.
An employer contributes Rs. 10 lakh in the current previous year, so PC is Rs. 2.5 lakh, being the excess over Rs. 7.5 lakh. If income accrued in the fund during the year is I and the average of the opening and closing balances is Favg, then R is I divided by Favg, and the taxable perquisite is (Rs. 2.5 lakh divided by two) multiplied by R, plus the sum of PC1 and TP1 for earlier years from 1 April 2020 multiplied by R.
Rules it names. Rule 3A of the Income-tax Rules, 1962. The 1962 Rules were replaced by the Income-tax Rules, 2026, which renumbered nearly everything: a rule number quoted here almost never means the same rule today.
