Notification No. 189

Amendment of the Income-tax Rules under section 115WD of the Income-tax Act, 1961

What this is

Notification No. 189 was published on 24 July 2006. Its subject is Amendment of the Income-tax Rules under section 115WD of the Income-tax Act, 1961.

This amends the Income-tax Rules. What it changes is the Rules, not the Act — and a rule can never take away what the section gives.

What it does

In exercise of the powers under section 295 of the Income-tax Act, 1961, the Central Board of Direct Taxes makes the Income-tax (7th Amendment) Rules, 2006. In rule 12 the heading "Return of income." is substituted by "Return of income and return of fringe benefits.", and sub-rule (1) is recast so that it governs the return of income under sub-section (1), the proviso to sub-section (1), or sub-sections (2), (3), (4A), (4B) or (4C) of section 139 or clause (i) of sub-section (1) of section 142, and also the return of fringe benefits under sub-section (1) or (2) of section 115WD or sub-section (3) of section 115WH. A new clause (f) is inserted after clause (e) providing that where a person must file both returns but has already filed the return of income for assessment year 2006-07 in Form No. 1, Form No. 2, Form No. 2D or Form No. 3A before publication of these rules, or opts for Form No. 2D, or where a person need not file a return of income but must file a return of fringe benefits, the return of fringe benefits shall be in Form No. 3B, verified as indicated therein. A new sub-rule (3) provides that a return in Form No. 1, Form No. 2, Form No. 3 or Form No. 3B shall not be accompanied by the computation of tax payable, proof of tax deducted at source, advance tax or self-assessment tax, or any document, account, Form or audit report otherwise required to be attached. In Appendix II, Form No. 1, Form No. 2 and Form No. 3 are substituted and Form No. 3B is provided.

Who it reaches

The provisions it speaks to

Left, the provision of the Income-tax Act, 1961 as the instrument itself names it. Right, the section of the Income-tax Act, 2025 that the department’s own concordance maps it to — which is where the same ground is now covered.

What it changes

The rule numbers are the 1962 Rules’ own, as the notification names them. The right-hand column is the department’s own mapping into the Income-tax Rules, 2026, which renumbered nearly everything.

From when

the date of publication in the Official Gazette.

What to watch

Where you meet it

At the filing counter for the return of income and the return of fringe benefits for assessment year 2006-07, and in any query about documents that were not attached to an annexure-less return.

What it names

Forms it names. Form No. 1, Form No. 2, Form No. 2D, Form No. 3, Form No. 3A, Form No. 3B

Rules it names. Rule 12 of the Income-tax Rules, 1962. The 1962 Rules were replaced by the Income-tax Rules, 2026, which renumbered nearly everything: a rule number quoted here almost never means the same rule today.

On the same provision

Other instruments in this library that name the same provision of the 1961 Act. They are not necessarily still operative, and a later one may have replaced an earlier one without saying so.

What a notification is. A notification is made under a power the Act itself gives, and within that power it is law — unlike a circular, which only binds the department. Its reach is the reach of the enabling provision and no wider, and the date it carries decides from when it works.
