Extension of time lines for filing of Income-tax returns and various reports of audit for the Assessment Year 2021-22
Circular No. 17/2021 was issued by the Central Board of Direct Taxes on 9 September 2021. Its subject is Extension of time lines for filing of Income-tax returns and various reports of audit for the Assessment Year 2021-22.
This is an extension of time. It moves a date that the Act or the Rules otherwise fix, and it does so only for the compliance and the period it names — not for anything else that happens to fall due at the same time.
Pushes back six dates for assessment year 2021-22, each already once extended by Circular No. 9/2021 dated 20 May 2021. The section 139(1) return date of 31 July 2021 goes to 31 December 2021; the audit report date for previous year 2020-21 of 30 September 2021 goes to 15 January 2022; the section 92E accountant's report date of 31 October 2021 goes to 31 January 2022; the section 139(1) return date of 31 October 2021 goes to 15 February 2022; the section 139(1) return date of 30 November 2021 goes to 28 February 2022; and the belated or revised return date under section 139(4) and section 139(5) of 31 December 2021 goes to 31 March 2022. Two clarifications qualify the relief. The extension of the return dates does not apply for Explanation 1 to section 234A where the tax on total income, reduced by the amounts in clauses (i) to (vi) of section 234A(1), exceeds one lakh rupees. And for a resident individual within section 207(2), tax paid under section 140A within the unextended due date is deemed to be advance tax.
Difficulties were reported by taxpayers and other stakeholders in the electronic filing of returns and of the various reports of audit.
