Effect of decision of the Supreme Court in Distributors (Baroda) (P.) Ltd. v. Union of India [1985] 155 ITR 120
Circular No. 341 was issued by the Central Board of Direct Taxes on 10 May 1982. Its subject is Effect of decision of the Supreme Court in Distributors (Baroda) (P.) Ltd. v. Union of India [1985] 155 ITR 120.
Fixes the cut-off year for the gross income basis of the section 80MM deduction. The Supreme Court in Cloth Traders (P.) Ltd. v. Addl. CIT had observed that the deduction under section 80MM is to be worked out on gross income. Section 80AB, inserted by Finance (No. 2) Act, 1980, requires it to be worked out on net income, and was made effective from 1 April 1981 and not retrospectively. The Board therefore clarifies that the Supreme Court's judgment applies to assessments up to and including assessment year 1980-81.
To tell officers how the judgment and the new section 80AB fit together, the section having been given prospective effect only.
